Trusts, Estates & Probate
I advise clients on all aspects of estate planning, including related tax issues, the establishment of living trusts, wills, durable powers of attorney for assets, advance health care directives and incapacity concerns.
Complex Trust and Estate Litigation
I represent clients in all types of complex trust and estate litigation, such as trust and will contests, including claims based on lack of mental capacity, undue influence and caregiver and other elder financial abuse, "safe harbor" proceedings, breach of fiduciary duty, accounting and surcharge, and claims to recover property improperly transferred.
Post-Death Estate Administration
Following a death, I counsel family members, beneficiaries, executors and trustees in both non-judicial trust administration and court supervised probate proceedings. I advise my clients on ongoing administration and trust accounting issues.
Juvenile & Adoption
I represent families in crisis when Child Protective Services has become involved and has detained children or has threatened detention. With years of expertise in this area of law, I use first class advocacy and meticulous knowledge of the law in order to represent my clients.
I can also help in obtaining successful placement of children with relatives, file de facto parent motions and establish visitation orders for other relatives.
I have advised many families hoping to become unified legally through the adoption process.
Conservatorships & Guardianship
I have assisted many families in establishing a conservatorship for an elderly family member or friend who can no longer care for themselves or make medical and/or financial decisions. These people may need the protection of a conservatorship when they are susceptible to undue influence.
A Limited Conservatorship can be established for a developmentally disabled adult. I use my expertise in this area of law in order to help families navigate the specific procedure in order to obtain a successful result.
